Terms and Conditions - Pulse Cars Ltd Birmingham

1. Contract

1.1 The vehicle order form for the sale of a motor vehicle and accessories (“the Goods”) by Pulse Cars Ltd Birmingham (“the Seller”) at the agreed price (“the Total Retail Price”) and any allowance in respect of a used motor vehicle offered by you (“the Buyer”) incorporates the following clauses to form the contract between us.


1.2 The vehicle order form (except where varied by an express agreement between the parties which is recorded in writing and signed by an authorised representative of Pulse Cars Ltd Birmingham) shall constitute the entire contract between the parties.


2. Delivery

2.1 Pulse Cars Ltd Birmingham will use reasonable endeavors to secure a delivery date or dates, but shall be under no liability whatsoever for loss occasioned by delay in delivery arising out of any cause beyond the control of Pulse Cars Ltd Birmingham.


2.2 The Goods may be delivered by Pulse Cars Ltd Birmingham or its agent in advance of the estimated delivery date, if any, upon giving 14 days prior notice to the Buyer.


2.3 Delivery shall be deemed to have been made on the date that the Goods are made available for collection by the Buyer and Pulse Cars Ltd Birmingham has given notice to the Buyer that the Goods are ready for collection. The Goods will be physically delivered by Pulse Cars Ltd Birmingham to the Buyer only where agreed by Pulse Cars Ltd Birmingham and at the Buyer’s cost.


2.4 Pulse Cars Ltd Birmingham may cancel the contract if the manufacturer ceases to make the Goods or if the manufacturer ceases to supply the Goods to the UK market. If Pulse Cars Ltd Birmingham is unable to supply any option or accessory, it may substitute a reasonable equivalent or delete the option or accessory from the contract. Inability to supply an option or accessory shall not constitute a breach of contract or entitle the Buyer to reject the Goods.


3. Price and Payment

3.1 The Goods will remain the property of Pulse Cars Ltd Birmingham until the Total Vehicle Price set out on the vehicle order form has been discharged in full. Time of payment shall be of the essence.


3.2 If the Buyer arranges for a finance company to purchase the Goods from Pulse Cars Ltd Birmingham, the Goods shall not be released until the Total Vehicle Price has been discharged in full, including receipt of cleared funds from the finance company.


4. Part Exchange

4.1 If Pulse Cars Ltd Birmingham allows part of the purchase price of the Goods to be paid by the Buyer delivering a used vehicle, such allowance is given and received as part of the sale and purchase of the Goods, subject to conditions specified.


4.2 Conditions related to part-exchange vehicles apply as set out in the vehicle order form.


5. Vehicle Breakdown and Return

In the event of a breakdown or for any other reason, it is the buyer’s responsibility to arrange and bear the costs of transporting the car back to our dealership for repairs.


6. Exclusive Repair Services

We will only accept repairs and maintenance services conducted by our authorized dealership. Any repairs carried out at unauthorized service centers will void any guarantees or warranties.


7. Maintenance Requirement for Guarantee

The guarantee coverage will be valid only for cars that are serviced regularly. Cars must be serviced every 6000 miles or every 6 months, whichever comes first, at our authorized dealership to be eligible for guarantee benefits.


8. Vehicle Acceptance Policy

Once a car has left the yard and has been driven for more than 30 miles, it will not be eligible for return or refund.


9. Refusal of Returns

We reserve the right to decline any returns after a car has been sold.


10. Mileage Charges

If a return is accepted, a charge of 0.50 pence per mile will be applied for every mile driven beyond the initial 30 miles.


11. Guarantee Repairs

For all repairs claimed under guarantee, a fee of £250 plus VAT will be applicable.


12. Engine and Gearbox Failure/Damage

In cases of engine or gearbox failure or damage, the maximum compensation or repair coverage will be £500.


13. Guarantee Coverage

The guarantee provided covers only engine and gearbox issues.


13(B) Maximum Number of Claims:

Each customer is entitled to a maximum of one claim under the guarantee provided. Once a claim has been made and processed, the guarantee coverage for the specific vehicle will be considered fulfilled, and no further claims can be made for the same vehicle.


14. Irreparable Engine/Gearbox

If the engine and gearbox are deemed irreparable, we may offer to buy back your car for up to 40% of its original value.


15. Return Policy

If you choose to return the car for any reason, a depreciation fee of 25% of the car’s value will be deducted, along with a £250 administrative fee and 20% VAT.


16. Exercise of Consumer Rights

If you choose to exercise your rights under the Consumer Rights Act of 2015 and request a return or refund, it is your responsibility to demonstrate that the fault or issue with the vehicle was indeed present at the time of sale. Please note that this clause is intended to align with the requirements of the Consumer Rights Act of 2015.


17. Dispute Resolution

Any disputes arising from these terms and conditions will be resolved through arbitration or mediation in accordance with United Kingdom’s laws.


18. Privacy and Data Usage

By engaging with our services, you agree to our privacy policy, which outlines how we collect, store, and use your personal information.


19. Modification of Terms

We reserve the right to modify or update these terms and conditions at any time. Any changes will be communicated to you via the contact information provided.


20. Governing Law

These terms and conditions are governed by the laws of United Kingdom. Any legal actions will be brought to the appropriate courts in England.
