Terms and Conditions

These terms govern every vehicle sale and related service provided by Pulse Cars Limited. Please read them carefully — by paying a deposit, reservation fee or by taking delivery of a vehicle you confirm that you have read, understood and accepted them.

1. Contract

1.1 The contract is formed on the date of sale and applies to all contracts for the supply by Pulse Cars Limited (“Pulse Cars”, “we”, “us”) of any vehicle to you, the customer, as set out in the Sales Agreement and any subsequent amendments agreed in writing.

1.2 Unless otherwise specified in writing, only the items expressly listed in the Sales Agreement are included in the price. Any additional goods, services, accessories or registration costs are chargeable separately.

1.3 These terms, together with the Sales Agreement, constitute the entire agreement between you and Pulse Cars and supersede any prior verbal or written representations.

2. Delivery

2.1 Pulse Cars will use reasonable endeavours to meet any delivery date agreed with you, but such dates are estimates only and time shall not be of the essence. Deliveries will be made during normal business hours or at a time mutually agreed.

2.2 Where Pulse Cars or its appointed agent delivers the vehicle, you will be liable for any reasonable costs incurred in connection with that delivery, as quoted in advance.

2.3 If you fail to take delivery when the vehicle is ready, or provide incomplete, incorrect or misleading delivery instructions, we may, without limiting our other rights, store the vehicle until delivery actually takes place. You will be liable for all related costs (including storage and insurance), and our responsibility for the vehicle from that point shall cease.

3. Price, Payment and Reservation Fee

3.1 The price of the vehicle is the amount quoted by Pulse Cars. VAT (where applicable) and any government or registration fees are payable in addition unless explicitly stated as included.

3.2 The standard deposit amount is £500.00. If Pulse Cars is unable to supply the vehicle, the deposit will be refunded in full to the original payment method.

3.3 Purpose of Reservation Fee

3.3.1 A reservation fee may be taken to secure a specific vehicle for a customer.

3.3.2 Payment of the reservation fee removes the vehicle from sale and reserves it exclusively for the customer for an agreed period.

3.3.3 By paying the reservation fee you acknowledge that Pulse Cars will cease marketing the vehicle and may lose other potential sales opportunities.

3.4 Reservation Period

3.4.1 Vehicles are typically reserved for up to 5 days, unless otherwise agreed in writing.

3.4.2 If you fail to complete the purchase within the agreed reservation period, Pulse Cars reserves the right to release the vehicle back to the market.

3.5 Reservation Fee Amount

3.5.1 The reservation fee may vary depending on the vehicle and will be communicated to you clearly before payment is taken.

3.5.2 The reservation fee forms part of the total purchase price if the transaction proceeds.

3.6 Refund Policy

3.6.1 The reservation fee is non-refundable if you choose not to proceed for personal or financial reasons, including but not limited to: change of mind, failure to arrange finance, deciding to purchase another vehicle, or delay beyond the agreed reservation period.

3.6.2 The reservation fee will be fully refunded if:

  • Pulse Cars is unable to supply the vehicle; or
  • The vehicle is materially misdescribed; or
  • A serious undisclosed fault is identified before purchase.

3.6.3 Refunds, where applicable, will be processed to the original payment method.

3.7 Finance Applications

3.7.1 Finance applications are subject to approval by the relevant finance provider. Pulse Cars acts as a credit broker, not a lender.

3.7.2 Pulse Cars does not guarantee finance approval.

3.7.3 If finance is declined or you choose another provider, the reservation fee remains non-refundable unless otherwise agreed in writing.

3.8 Vehicle Inspection

3.8.1 You are encouraged to inspect the vehicle in person before completing the purchase. Independent inspections may be arranged at your own expense.

3.9 Agreement

3.9.1 Payment of any deposit or reservation fee confirms that you have read, understood and accepted these terms and conditions.

4. Part Exchange

4.1 Where part of the purchase price is paid by Pulse Cars taking your existing vehicle in part exchange, you acknowledge that the agreed valuation is based on the description and condition provided by you at the time of the offer.

4.2 The part-exchange valuation may be re-assessed if, on inspection, the vehicle differs from your description (including undisclosed damage, faults, outstanding finance, mileage discrepancies or missing documentation). Pulse Cars is not liable for any loss arising from such re-valuation.

4.3 You warrant that any part-exchange vehicle is your legal property, free of any undisclosed finance, charge or claim, and that all details supplied are accurate.

5. Vehicle Breakdown and Return

This section applies only where Pulse Cars is responsible for the relevant fault and the vehicle has been returned to Pulse Cars for inspection and repair. You must contact us immediately upon discovery of any fault and refrain from further use that could aggravate the issue.

6. Authorised Repair and Spare Services

We will only accept spare-parts work and repairs carried out by our authorised garage. Any repair, modification or part replacement performed at a non-authorised facility without our prior written consent will void any applicable guarantee or warranty.

7. Maintenance Requirements for Guarantee

You must maintain the vehicle in accordance with the manufacturer's recommended service schedule. Failure to service the vehicle at the required intervals (or at least every 6 months, whichever comes first) at an authorised facility will render the vehicle ineligible for any guarantee benefits.

8. Vehicle Acceptance Policy

You are responsible for inspecting the vehicle prior to accepting delivery and for informing us in writing of any visible faults at that time. Once delivery has been accepted without notice of fault, Pulse Cars is not liable for cosmetic claims or repairs in respect of issues that would have been apparent on reasonable inspection.

9. Refusal of Offers

Pulse Cars reserves the right to refuse or withdraw any vehicle offer at its sole discretion and at no cost to the customer, prior to the formation of a binding contract.

10. Mileage Changes

If the vehicle has been driven more than 500 miles after delivery, you will no longer be eligible for any refund beyond the statutory 14-day short-term right to reject under the Consumer Rights Act 2015.

11. Guarantee Repairs

Repairs carried out under any guarantee are subject to parts availability. Pulse Cars will not be liable for delays caused by manufacturer or supplier lead times. Where equivalent quality parts are available, they may be used at our discretion.

12. Engine and Gearbox Claims / Damage

Any claim relating to the engine, gearbox or other major mechanical components must be reported to Pulse Cars immediately upon discovery and before any independent repair work is commenced. The vehicle must be made available to us or our authorised garage for inspection. Continued use of the vehicle after a fault becomes apparent may invalidate the claim.

13. Guarantee Coverage

Unless an extended warranty has been purchased separately, our standard guarantee provides cover only against gearbox failure. The scope and duration of any extended warranty is determined by the third-party warranty provider and the policy documents supplied at the time of sale.

14. Maximum Number of Claims

A maximum of 3 claims may be made during the entire guarantee period. The guarantee period continues to run until expiry regardless of claims made. Any failure attributable to normal wear and tear, misuse, accident, modification, neglect or lack of maintenance is excluded.

15. Insurance

You are fully responsible for arranging and maintaining valid motor insurance for the vehicle from the moment of collection or delivery. Pulse Cars accepts no liability for any loss or damage arising from the absence of valid insurance.

16. Cancellation of Services

Any service procured through Pulse Cars Limited may be cancelled only upon the customer's formal written request and shall, in all circumstances, be strictly non-refundable.

17. Cancellation of Ancillary Services

In the event of cancellation of a vehicle sale, all ancillary services purchased in connection with that sale (including but not limited to warranties, paint protection, service plans, GAP insurance and delivery) shall be deemed automatically cancelled. Any sums paid in respect of such services shall be non-refundable in full.

18. Return Policy

Where you elect to return the vehicle for reasons other than those protected by statutory rights, a sum of £1,000 plus the deposit will be retained to cover diminution in value and administrative costs. This clause does not affect your statutory rights under the Consumer Rights Act 2015.

19. Exercise of Consumer Rights

19.1 Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015. Vehicles sold by Pulse Cars must be of satisfactory quality, fit for purpose, and as described.

19.2 If you choose to exercise your rights under the Consumer Rights Act 2015 and request a refund or reject a faulty vehicle, the following will apply:

  • Any refund will be subject to inspection and approval by Pulse Cars.
  • There must be satisfactory evidence that the vehicle is at fault and the complaint is justified.
  • The vehicle must be returned in the same condition as when purchased.

20. Dispute Resolution

Any dispute arising from these terms will, in the first instance, be addressed by contacting Pulse Cars in writing. If the matter cannot be resolved internally, the parties will use reasonable endeavours to resolve it through mediation or arbitration in accordance with the laws of the United Kingdom before commencing court proceedings.

21. Privacy and Data Usage

We respect your privacy and handle your personal data in accordance with the UK GDPR and the Data Protection Act 2018. Your data is used to complete your vehicle purchase, to provide after-sales service, and to comply with our legal obligations. Full details are set out in our Privacy Policy.

22. Modification of Terms

We reserve the right to modify these terms and conditions at any time. Any changes will take effect from the date they are published on our website or otherwise notified to you. The version in force at the date of your Sales Agreement applies to that sale.

23. Governing Law

These terms and conditions are governed by the laws of England and Wales. The parties submit to the exclusive jurisdiction of the courts of England and Wales for any matters arising from or in connection with this agreement.

24. Limitation of Liability

24.1 Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

24.2 Subject to clause 24.1, Pulse Cars' total liability to you in connection with the vehicle, however arising, shall not exceed the purchase price paid by you for that vehicle.

24.3 Pulse Cars shall not be liable for indirect, special or consequential losses, including loss of profit, loss of use, loss of income or loss of opportunity.

25. Third-Party Finance and Warranty Products

Where finance, insurance or extended warranty products are arranged through a third-party provider, those products are governed by the terms and conditions of that provider. Pulse Cars is not the underwriter and accepts no liability for the conduct or decisions of any third-party provider.

26. Force Majeure

Pulse Cars shall not be liable for any failure or delay in performing its obligations under these terms where such failure or delay results from events beyond our reasonable control, including but not limited to acts of God, war, strikes, supplier or manufacturer delays, transport disruption, fire, flood, epidemic or government action.
